Terms of Service

1. Agreement
By creating an account or using MySwimSet (“the Service”), you agree to these Terms of Service (“Terms”). If you don't agree, don't use the Service.
MySwimSet is operated by Awarded LLC, a North Carolina limited liability company (“we,” “us”). Contact: kevin@myswimset.com.
2. What MySwimSet Does
MySwimSet is a web-based workout management platform for swim coaches. It lets you write workouts, manage a roster of coaches and training groups, view training analytics, and print practice cards.
3. Your Account
- You must be at least 18 years old to create an account, or have permission from a parent or legal guardian.
- You're responsible for the activity on your account. Keep your password secret.
- Provide accurate information when signing up. If something changes (your name, email), update it.
- One person, one account. Don't share login credentials.
4. Subscriptions and Billing
- MySwimSet is currently free for founding coaches, with no credit card required. The terms in this section describe how billing will work when paid plans launch; they do not apply while your access is free.
- When paid plans launch, they will include a free trial with no credit card required, and founding coaches will be offered locked-in pricing before any charge applies.
- Paid plans are billed monthly or annually. Current pricing: Coach ($19/month or $149/year), Team ($49/month or $399/year), plus optional additional programs at $5/month each. Prices are in US dollars and may change with 30 days' notice.
- Subscriptions renew automatically until canceled. You can cancel any time from your account settings; cancellation takes effect at the end of your current billing period.
- Refunds are generally not provided for partial periods. If you believe you were charged in error, email us and we'll work it out.
- If a payment fails and isn't corrected within 14 days, we may suspend or downgrade your account.
5. Your Content
You retain ownership of the workouts, sets, programs, and other content you create in MySwimSet (“Your Content”). By using the Service you grant us a limited license to store, display, and process Your Content solely to provide the Service to you and your team.
We won't share Your Content with anyone outside your team without your permission. We won't use Your Content to train AI models or sell it.
Swimmer profiles.Your Content includes any swimmer profile you build: names, optional birth dates, contact emails, attendance, results, goals, and wellness check-ins. A profile is a record about a swimmer, not an account; swimmers do not have logins. By entering swimmer information you represent that you have the authority to do so, from your club, school, or program and, where required, from the swimmer's parent or guardian, and that you will share a minor's report link only with a parent or guardian. 6. Acceptable Use
Don't use MySwimSet to:
- Violate any law or anyone's rights.
- Upload malware, attempt to break into the Service, or interfere with other users.
- Resell or sublicense the Service without our written permission.
- Scrape, harvest, or systematically extract data from the Service.
- Impersonate anyone or misrepresent your affiliation with a team.
If you violate these rules, we may suspend or terminate your account.
7. Service Availability
We aim for reliable uptime but don't guarantee the Service will be uninterrupted or error-free. Maintenance, third-party outages (Supabase, Vercel), and unexpected bugs can happen.
8. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if your payment fails, or if continuing to provide service becomes impractical for us (with reasonable notice when possible).
On termination, you can export Your Content for 30 days before it's deleted from active systems.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, MySwimSet's total liability arising out of or relating to these Terms or the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Governing Law
These Terms are governed by the laws of the United States and the State of North Carolina, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in North Carolina.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date and notify registered users by email at least 14 days before the changes take effect. Continued use after that means you accept the new Terms.
